Doubts about obligations under the legislation?

The Consolidation Act on the Protection of Health and Safety in the Workplace defines the use of work equipment and personal protective equipment.

In general, all work equipment and devices must:

  • comply with specific legal provisions
  • comply with EU product directives
  • meet general safety requirements
  • meet general safety requirements
  • checked and stored correctly.

What is meant by control and proper storage?

Safe management involving proper maintenance of work equipment, periodic and extraordinary inspection and, in the case of certain specific categories, periodic verification.

Which equipment is subject to safe management?

The name of the equipment should be taken from its EC declaration of conformity or from the accompanying instructions. The following equipment is some of those subject to safe handling.

  • Operating machines and tools
  • Gantry cranes
  • Lifting machines for materials
  • Elevating work platforms
  • Hooking and lifting systems
  • Individual and collective protective equipment
  • Ladders

Who can carry out checks and maintenance?

Competent technical staff or specialised companies.

Does maintenance replace verification?

Absolutely NO. Initial and periodic inspections are mandatory for certain specific types of equipment and machinery.

Who can carry out the checks?

Only authorised bodies (ASL, INAIL, ARPA, VVF) or private entities.

What are the risks?

For failure to carry out checks fines of up to 1,800 euro. For failure to maintain safety standards imprisonment from 3 to 6 months for the employer/manager or a fine of up to EUR 6,400.
